Referral Program Terms
Last updated: November 3, 2026
These Referral Program Terms (the "Referral Terms") govern participation in the GWINS Gear referral program (the "Program"). The Program is operated by GWINS Gear. By using a referral code, participating as a referrer, or placing an order through a referral, you agree to these Terms and to our Terms of Service.
1. Who Can Participate
You must be at least 18 years old (or the age of majority in your jurisdiction), have an active GWINS Gear account in good standing, and be a resident of a country where we ship. Employees, contractors, immediate family members of GWINS Gear staff, and current sponsored team members under a separate written agreement are not eligible to earn referral commission unless we state otherwise in writing.
2. How the Program Works
- Every eligible account can request a unique referral code.
- When a new customer places their first qualifying order using your code at checkout, you earn a 10% commission on the item subtotal (before shipping, taxes, and discounts).
- The new customer receives a 10% discount on their first order (or a value we may change from time to time; the active value is shown with the code).
- Commissions are tracked by Shopify and reviewed monthly.
3. "Qualifying Order"
An order qualifies for commission if all of these are true:
- The buyer is a new customer who has not placed an order with GWINS Gear before.
- The buyer applied your referral code at checkout before completing payment.
- The order is paid in full and shipped.
- The order is not fully refunded or charged back within the 30-day holding period.
Partial refunds reduce the commission proportionally. Fully refunded or charged-back orders earn no commission.
4. Payment of Commissions
- Commissions are held for 30 days after the order ships to allow for returns and chargebacks.
- Payouts are issued monthly for all commissions that cleared the 30-day holding period.
- Minimum payout threshold is US $25. Balances below the threshold roll over to the next payout cycle.
- Payouts are issued by PayPal or store credit, at your choice. Other methods may be added later.
- You are responsible for any taxes owed on commission income. We may be required to issue a tax form (such as IRS Form 1099-NEC in the US) if you receive US $600 or more in a calendar year. You agree to provide valid tax information when requested; without it we may delay or withhold payouts as required by law.
5. How to Share Your Code
You may share your code with people who would plausibly be interested in GWINS Gear: friends, teammates, team Discords, your social accounts, and similar personal networks. When you share your code publicly, you must clearly disclose that you earn a commission (for example, "#ad" or "I earn a commission on orders made with my code"), as required by the FTC Endorsement Guides and similar rules in other jurisdictions.
6. What You May Not Do
Participation is void if you:
- Create fake or duplicate accounts to self-refer or to inflate commissions;
- Use your own code on your own orders, or coordinate with household members to do so;
- Post your code on coupon aggregators, discount sites, cashback sites, deal forums, extensions, incentivized traffic networks, or ad placements bidding on GWINS Gear brand terms;
- Spam your code to people who did not opt in, including unsolicited email, SMS, or DM blasts;
- Represent yourself as a GWINS Gear employee or sponsored athlete when you are not;
- Use misleading, defamatory, or infringing content when promoting your code;
- Violate the FTC Endorsement Guides or equivalent rules.
If we determine that commissions were earned in violation of these Terms, we may deny, reverse, or claw back those commissions and terminate your participation.
7. Changes and Termination
We may modify or end the Program, change the commission rate, change the holding period or minimum payout, or terminate any participant for any reason, at any time, with notice posted on this page. Changes apply going forward only.
8. No Employment or Agency
You are an independent participant, not an employee, contractor, agent, or franchisee of GWINS Gear. These Terms do not create a partnership or joint venture.
9. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws rules.
