Community Content Terms (GWINS Army)

These Community Content Terms (the "UGC Terms") apply when you upload, submit, tag, or otherwise share content with GWINS Gear through the GWINS Army feed, our community pages, our social media accounts (including when you tag @gwinsgear or use the hashtag #GWINSArmy), referral posts, team-member submissions, or any similar channel ("Community Content"). By submitting Community Content, you agree to these Terms and our Terms of Service.

1. What Counts as Community Content

Photos, videos, clips, captions, product reviews, testimonials, tournament footage, team media, apparel-on-field shots, and anything else you submit, upload, or publicly tag with GWINS Gear.

2. Your Representations and Warranties

By submitting Community Content, you confirm that:

You are at least 18 years old or you have your parent or legal guardian's permission to submit it.
You created the content, or you have obtained all necessary rights, licenses, releases, and permissions from everyone featured in it (including athletes, teammates, bystanders, and minors) and from the owner of any location shown.
The content does not violate anyone's rights (privacy, publicity, copyright, trademark, trade secret, or contract) and does not contain unlawful, defamatory, obscene, hateful, discriminatory, harassing, or infringing material.
The content accurately describes your experience and does not include undisclosed sponsorship or compensation that would require an FTC disclosure.
If the content shows product performance, you understand that paintball apparel is not protective equipment and that we may edit, caption, or add safety context when we republish.

3. License You Grant to GWINS Gear

You grant GWINS Gear and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, display, perform, distribute, adapt, modify, create derivative works from, and promote your Community Content, in whole or in part, in any media now known or later developed, for any purpose related to the Services, our marketing, our products, our sponsored teams, or our brand.

This includes the right to use your handle, name, likeness, or team affiliation as reasonable credit alongside the content. If you prefer to be credited by a specific handle, add it to the caption at the time of submission.

4. No Compensation Unless Agreed in Writing

Submitting Community Content does not entitle you to payment, discount, credit, or product unless we have agreed to it in a separate written agreement (for example, a signed ambassador or team-sponsorship agreement). We may, at our discretion, send gifted product, a discount code, or a feature in the GWINS Army, but we are not required to.

5. Takedown and Edits

We may, at any time and without notice, decline to publish, remove, edit, caption, crop, or stop using any Community Content. If you want us to take down a specific piece of your content, email waldojmartinez@gmail.com with a link to it and a short description. We will act on reasonable takedown requests promptly, except where retention is required by law or by the licenses already granted to third parties who republished it before the takedown.

6. Rights We Do Not Claim

You keep ownership of your Community Content. These UGC Terms are a license to GWINS Gear, not a transfer of copyright. You remain free to use your content elsewhere.

7. Prohibited Submissions

Do not submit content that:

Shows minors without a parent or guardian's written consent;
Shows a person who has not agreed to be featured;
Portrays unsafe behavior (unmasked play, chrono violations, aiming at non-participants);
Depicts drugs, weapons beyond paintball markers, violence, or illegal activity;
Includes brand logos (other than GWINS Gear and NY Aces) in a way that implies partnership we don't have;
Uses someone else's photo or video without permission.

8. DMCA and Intellectual Property Complaints

If you believe content on the Services infringes your copyright, follow the process in our DMCA Policy or email waldojmartinez@gmail.com with the required information.
